Terms & Agreement
These are the terms that apply to your Web Surgeon X website service. I've kept them clear and honest so you know exactly where you stand.
1. The agreement
This agreement is made between Web Surgeon X ("we", "us", "the provider") and you, the client ("you", "the client"). It covers the design, build, hosting and ongoing maintenance of your website. By signing the contract, you confirm that you have read, understood and accepted these terms.
2. Pricing & payment
The fee for designing and building your website (the "store") is £1,200, payable upfront before work begins. Following launch, an ongoing fee of £150 per month is payable for hosting, maintenance and support. The monthly fee is charged on a recurring basis for the duration of the agreement.
3. 12-month term
The monthly service operates on a fixed 12-month contract from the date of your first monthly payment. By signing, you commit to the full 12 monthly payments of £150 (a total of £1,800 across the term, in addition to the £1,200 upfront build fee). After the initial 12 months, the agreement continues on a rolling monthly basis unless cancelled.
4. What's included
The upfront fee covers the full design and build of your website. The monthly fee covers hosting, SSL/security, uptime monitoring, reasonable ongoing content updates, bug fixes, general maintenance and direct support. Large new features, additional websites or substantial redesigns may be quoted separately and agreed in advance.
5. Your responsibilities
You agree to provide the content, materials, branding and information reasonably needed to build and maintain your website in a timely manner, and to ensure you hold the rights to any materials you supply. Delays in providing materials may affect the build timeline.
6. Ownership & hosting
On full and continued payment, the design and content of your website are yours. While your site is hosted and maintained under this agreement, it remains on infrastructure managed by Web Surgeon X. If the agreement ends, we will work with you in good faith to assist with a reasonable handover of your website files.
7. Support
Support and maintenance are provided directly during normal working hours. We aim to respond to requests promptly. The monthly fee covers reasonable ongoing changes; work that goes significantly beyond routine maintenance may be quoted as additional work.
8. Cancellation
The 12-month term is a committed period; the monthly fee remains payable for the full term. After the initial 12 months, you may cancel the rolling monthly service by giving 30 days' written notice. Upfront build fees are non-refundable once work has commenced.
9. Liability
We take great care to keep your website secure and online, but we cannot guarantee uninterrupted availability and are not liable for losses arising from third-party services, downtime outside our control, or content supplied by you. Nothing in these terms limits liability where it cannot lawfully be limited.
10. Changes to these terms
We may update these terms from time to time. Where changes materially affect your agreement, we will let you know. Your continued use of the service constitutes acceptance of the updated terms.
